The save-home decree is law!
SAVE HOME DECREE: FREE BUILDING AND SOLAR PROTECTION WORKS
The Salva Casa Decree was converted into law with L. 07/24/2024, n. 105, published in the Official Journal of 07/27/2024, n. 175 and in force from 07/28/2024.
It contains urgent measures regarding building and urban planning simplification to support the growing housing need and the recovery of existing building stock.
There are also measures to simplify solar protection works. In particular, the possibility of creating porticos, in addition to loggias, is granted without the need for specific authorizations, therefore in a free building regime.
The Salva Casa 2024 Decree makes significant changes to art. 6, paragraph 1, of Presidential Decree 380/01 Consolidated Building Law (TUE), including the following in free construction:
- the removable panoramic windows VePA (amendment to letter b-bis), art. 6, paragraph 1);
- works for protection from the sun or atmospheric agents (introduction of letter b-ter), art. 6, paragraph 1).
This insertion is aimed at completing the possibilities of installing panoramic windows which, as is known, some Local Administrations already prohibited when installed in porticos because such installation was not mentioned in the previous decree.
As for pergolas, the rules for installing awnings, pergola awnings with retractable canvas or mobile sun protection elements are simplified. In particular:
- curtains
– awnings
– outdoor curtains
– pergola awnings, also pergolas
bioclimatic, with retractable awning, even waterproof with mobile or adjustable solar protection elements.
These structures can be built under the free building regime, provided that some specific conditions are respected: they must be attached to or annexed to buildings or real estate units, even if they require fixed structures for their support and extension.
These structures must not create closed spaces, so as to avoid variations in volumes and surfaces, and must be in harmony with the pre-existing architectural context.
The Salva Casa Decree therefore allows the installation, under free building regulations, of all those structures that have the following characteristics: waterproof canvas and, for pergola awnings, mobile or adjustable elements (typical characteristics of orientable and/or packable bioclimatic pergola awnings).
